The Ontario Superior Court of Justice has approved a Yaz and Yasmin class action lawsuit. The lawsuit includes all women residing in Ontario and Quebec who used Yaz and/or Yasmin from 2004 – 2011.
The unique aspect of this class action lawsuit is that it automatically includes Yaz and Yasmin users, regardless of whether or not they have formally requested inclusion in the case. The legal representatives of the plaintiffs have posted information about how to opt-out of the case. If a woman prefers to opt-out, she must do so before February 9, 2015.
This Yaz and Yasmin class action lawsuit targets the drugs’ manufacturer, Bayer, and centers around injuries suffered by plaintiffs. These Yaz and Yasmin injuries include blood clots, pulmonary embolism, deep vein thrombosis, gallbladder disease, and stroke. The Canadian case alleges that Bayer was aware of the risks associated with both of their contraceptive drugs, but failed to give proper warning to health care providers and patients regarding these serious side effects.
Similar suits have been filed in the U.S. by Carey Danis & Lowe on behalf of women whose lives have been forever changed by these two contraceptive drugs, as well as by the generic version, Ocella.
