Following a trucking accident that caused the death of 24-year-old Urias Reyes, the man’s parents, Pedro and Julita Reyes, have filed a wrongful death lawsuit. The suite alleges that the driver of a semi truck failed to yield the right of way. The suit was filed on November 14 and is against James Dean Stanton, the driver of the truck, Anderson Trucking Services Inc., the trucking company Stanton worked for, and Farmers Texas County Mutual Insurance Company.
The collision involved a 1993 Mazda MX-6 and a 2006 Freightliner Truck with a 2005 TRAO trailer. On May 29, Urias Reyes was driving the Mazda northbound on US 59 when he struck the semi truck. Stanton, the semi’s driver, had pulled out of an Exxon truck stop. He was blocking northbound lanes of the highway while he was stopped, waiting for traffic to clear so he could travel southbound. According to the suit, Reyes was unable to stop or avoid the trailer.
Accusations of negligence against Stanton include inattentive operation of his truck, stopping the truck in a live traffic lane, blocking the northbound traffic lanes, failure to yield to the deceased’s right of way, failure to accelerate in a prudent and timely manner, failure to keep a reasonable amount of distance from Reyes’ vehicle as ordinary prudent care would have dictated, and failure to turn his truck in an effort to avoid the accident.
Depending on the decision of the court, the Plaintiffs could receive an award of wrongful death and survival damages for termination of the parent-child relationship, physical pain and suffering, mental anguish, loss of consortium, loss of financial support, loss of inheritance, court costs, funeral expenses, and interest.
