Bard vaginal mesh multidistrict litigation (MDL). The PTO #167 pertains to cases selected for the bellwether trial process.
As mentioned in the PTO, one of these bellwether cases involving the plaintiff Debra Wise came to a settlement before going to trial. The order does not provide any details on the settlement. The Debra Wise case is Wise, et al. v. C.R. Bard, Inc., 2:12-cv-01378.
Though the PTO reveals nothing about the Wise settlement, the decision on the part of the vaginal mesh manufacturer, C.R. Bard, to settle the bellwether case before the trial start date of February 18, 2015 is important. According to the team of defective medical device lawyers at Carey Danis & Lowe, the decision to settle could have been influenced by a number of factors, including pressure from the court.
A Reuters report from early February 2015 quoted the federal judge presiding over the C.R. Bard MDL as saying that he was “going to kick it into high gear”, in reference to working to resolve the tens of thousands of cases targeted at C.R. Bard and six other vaginal mesh manufacturers.
