NuvaRing lawsuits continue to be filed across the country with 55 new cases being filed in a St. Clair County Circuit Court in Illinois. According to The Madison Record, 55 individuals have filed a lawsuit against the manufacturer of the NuvaRing, Merck & Co., Inc., alleging that the contraceptive device manufacturer failed to warn healthcare providers and the public about the serious health risks associated with use of the medical device.
In addition, these 55 plaintiffs in the Illinois NuvaRing lawsuit state that Merck pursued its NuvaRing marketing campaign knowing that the contraceptive device was linked to severe health complications.
Health risks associated with the use of the NuvaRing include the following:
- deep vein thrombosis (DVT)
- pulmonary embolism
- blood clot formation
- stroke
- heart attack
Made of flexible plastic, the NuvaRing, as its name connotes is a ring-shaped contraceptive device that releases small doses of two hormones, progestin and estrogen. It is believed that this hormonal combination causes the formation of blood clots and other serious health complications.
Approximately 575 NuvaRing cases have consolidated into a NuvaRing multi-district litigation (MDL) in the U.S. District Court for the Eastern District of Missouri. The Nuvaring MDL is known as in re: NuvaRing Products Liability Litigation MDL no. 1964, and is being presided over by Judge Rodney W. Sippel.
At present, according to the NuvaRing MDL website, both parties are “concluding written discovery and conducting depositions.”
Furthermore, cases in the NuvaRing MDL have been selected for bellwether trials. However, the bellwether trial dates have not been selected. Though word has been spreading that the bellwether trial date has been set for sometime in July 2013.
