J&J Document Destruction Investigation Continues

ethicon johson johnsonThe reason behind Johnson and Johnson’s (J&J) mishandling of key documents relating to their transvaginal mesh products remains unknown. As these documents could prove invaluable to those building a case against J&J and their subsidiary, Ethicon, over injuries allegedly caused by the pharmaceutical giant’s transvaginal mesh, an advocacy organization has stepped in to bring the matter before the U.S. Justice Department.

According to an article written by The Boston Globe in late March 2014, the Corporate Action Network contacted Attorney General Eric Holder with a request to more closely review J&J’s handling of these important documents.

A Corporate Action Network representative was quoted in the article as saying that the transvaginal mesh manufactured by J&J and Ethicon has caused serious injuries in women. The representative also claimed that J&J and Ethicon did not provide health care providers and patients adequate warning about the risks associated with use of their transvaginal mesh products. As such, they must face the consequences of knowingly withholding important health and safety information.

Transvaginal mesh lawsuits from across the country have been consolidated into a multidistrict litigation (MDL) in West Virginia. The court resolved in February that J&J had mishandled documents, but for lack of evidence, could not make a determination as to whether the company’s actions were calculated.
